BES – Building Energy Solutions Ltd. (BES) is committed to protecting personal information in compliance with the Personal Information Protection and Electronic Documents Act (PIPEDA), the Data Protection Acts 1988–2018 and the General Data Protection Regulation (GDPR). This policy sets out the standards for the collection, use and disclosure of personal information obtained through the BES website.

Scope

In accordance with the appropriate legislation and regulations, BES collects, uses and discloses personal information for legitimate business purposes that a reasonable person would consider appropriate in the circumstances. The company makes all reasonable efforts to obtain express consent before collecting, using or disclosing personal information, and where it intends to do so for a specified purpose, individuals receive notice and the reason for it.

Collection, use and disclosure

Personal information is only collected when it serves legitimate, reasonable business purposes, and is used solely for the reason it was collected. If it is used or disclosed for any other reason, the company obtains the express consent of the individual, except where required by law. The company informs the individual verbally or in writing of the purpose of collection at the time of, or before, collecting their personal information. BES may share personal information with third parties to fulfil the purpose for which it was collected.

The website may contain links to external websites; BES is not responsible for the privacy practices of other organisations.

Safeguarding personal information

BES is responsible for the personal information in its possession and control, including information shared with a third party for processing. Where information is shared with a third party, contracts are in place to ensure it is adequately protected.

Personal information collected through the website is stored electronically. The company safeguards personal information from unauthorised access, disclosure, use or modification and against theft or loss, regardless of the format in which it is stored, with safeguards appropriate to the sensitivity of the information. Information is protected through physical, organisational and technical measures, and access is restricted to employees and other agents of the company who require it to perform their duties, and to those otherwise authorised by law. Computer network systems and databases are secured through security protocols and best practices, and employees who handle personal information are made aware of the importance of maintaining its confidentiality.

The company retains personal information only for as long as it is needed. Once it is no longer required, it is promptly destroyed or de-identified so that it cannot be associated with individuals. Where law requires that personal information be kept for a specified period, the company complies with the applicable legislation and regulations.

Access to and amending personal information

BES grants an individual access to their personal information held by the company on request. On request, BES provides individuals with their personal information under the company’s control, information on how it has been used, and whether it has been disclosed to individuals or third parties. If the company denies a request, written notice is provided stating the reason for the refusal. The company makes reasonable effort to assist individuals and to respond as completely and accurately as possible.

Where an individual finds an error in their personal information, they may submit a written request and the company will action the necessary corrections. Requests must be submitted in writing to the Director of Operations at info@bes-energy.com. The company responds to all requests within 30 days of receipt, except where the timeline is extended in accordance with the appropriate legislation or regulator.
